W.P.(C) 4270/2019, CM No. 19079/2019 The present petition has been filed by the petitioner with the following prayers:
"In view of the foregoing facts and circumstances it is most respectfully prayed that this Hon‟ble Court may graciously be pleased to:
A.
Issue a Writ in the nature of mandamus or other suitable writ or order or direction thereby directing the
respondent No.1 to immediately take action against the Owner / Builder and occupier i.e. the respondent No.2 by booking, sealing and demolishing the properties being Birla Flats No.1, 6 & 9, Elahibus Road, Naiwalan, Karol Bagh, New Delhi-110005 as per the provisions of the Delhi Municipal Corporation Act; and B.
Pass such other Writ or direction in the nature of mandamus or other suitable writ or order or direction thereby directing the respondent No.1 to immediately take action against the Owner and occupier i.e. the respondent No.2 and stop the respondent No.2 to allow any third party occupy such a dangerous structure; and C.
Pass any other order or orders in favour of the Appellants this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the present Appeal be also passed in favour of the Appellant and against the respondent."
Learned counsel for the petitioner states that the matter is pending consideration with the Special Task Force. He states he shall make complaint to the Special Task Force and pursue the same. He therefore wishes to withdraw the writ petition. The writ petition and connected application are dismissed as withdrawn.
