The present petition has been filed by the Petitioner- Mr. Manish Vashist under Article 226 of the Constitution of India, inter alia, seeking directions to the Registrar Cooperative Societies (hereinafter, 'RCS') to forward the name of the Petitioner to the Delhi Development Authority (hereinafter, 'DDA') for draw of lots for the allotment of flat in the Home Living CGHS Ltd. (hereinafter, 'the Society'). 3.

The brief background of the present case is that the Petitioner became a member of the Society in 2003. The Petitioner was also issued the share certificate sometime in 2004.

Thereafter, the society had issued a no-dues certificate dated 6th December, 2021 to the Petitioner.

However, despite this, the grievance of the Petitioner is that the recommendation is not being made by the RCS to the DDA for draw of lots for the allotment of flat.

Ld. Counsel for the Petitioner submits that the no-dues certificate dated 6th December, 2021 would show that apart from the land costs and other costs which were to be paid within the remaining amount, such as maintenance, etc., all the other amounts have been paid by the Petitioner. Ld. Counsel submits that the no-dues certificate dated 6th December, 2021 is attached at Annexure J.

On behalf of the RCS, ld. Counsel submits that the Society has communicated to the RCS, vide communication dated 29th April, 2026, a list of 64 members, in whose favour no objection certificates have been issued. 9.

It is further submitted that the name of the Petitioner does not figure in the said list. The Society is stated to be in the process of verifying the status of the remaining members.

Heard. The Court has perused the no-dues certificate dated 6th December, 2021 attached as Annexure J.

A perusal of the no-dues certificate dated 6th December, 2021 would show that all the dues were cleared, as on the said date. If there are further dues, the Petitioner is willing to pay the same for the previous five years as well.

Accordingly, let the Petitioner and the officials of the Managing Committee of the Society appear before the RCS on 2nd June, 2026 at 11:30 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

After verifying the relevant documents, the society shall issue the no objection certificate to the RCS and the RCS shall recommend the name of the Petitioner to the DDA for draw of lots and for allotment of the flat. 14.

Considering the fact that the Petitioner has been a member of the society since 2003, the delay would be completely unwarranted. 15.

The entire process shall be completed within a period of three months. 16.
