Heard learned counsel for the parties.

This public interest litigation petition raises certain issues relating to property bearing no. B-2 & B-2 A, Old Plot No. 4, Khasra No. 2341/628/58, West Jyoti Nagar, Shahdara, Delhi-110094. The assertion is that certain illegal and unauthorised constructions is being made on the government land/road/street (gali) and accordingly a direction has been sought to be issued to the Authorities to take appropriate steps for removal of the said encroachment.

For the said purpose, the complaint is said to have been made by the petitioner.

Learned counsel for the MCD on instruction, states that the said complaint was attended to and it has been found on inquiry that the construction is being done on the basis of a sanctioned building plan. He, however, assures that if any construction is done beyond the sanctioned plan, appropriate action shall be taken by the MCD. 5.
Accordingly, this petition is disposed of in terms of the statement made by the learned counsel for the MCD. We, further direct that in case any encroachment on the public street or land is found, appropriate action which may be warranted under law shall be taken by the Authorities concerned.
