Learned counsel for the petitioner submits that an application under the Insolvency Court has been accepted against the respondent and an Insolvency Professional has been appointed.

Learned counsel submits that by order dated 24.08.2017 in Company Petition No.(IB) - 211(ND)/2017 titled M.Y. Agro Private Limited versus Amira Pure Foods Private Limited, he has already lodged his claim before the Insolvency Professional.

Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the Court, if the need so arises. 4.

In view of the above, the petition is dismissed as withdrawn with liberty to the petitioner, as prayed for.
