O R D E R

% 18.10.2024 I.A. 42516/2024 (O-XXIII Rule 3 of CPC) 1.

This is a joint application filed on behalf of the plaintiff and the defendants under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 (CPC) for recording the settlement arrived at between the parties. 2.

The application bears the signatures of authorized representatives of the plaintiff as well as the defendants and their respective counsel. The application is also supported by affidavits of the authorised representatives of the plaintiff as well as the defendants.

The terms of the settlement are described in paragraph 2 of the application.

I have gone through the terms of the settlement and do not find anything unlawful therein.

The parties shall remain bound by the terms of the settlement. 6.

Accordingly, the application is allowed.

CS(COMM) 307/2024 7.

In view of the order passed above, the present suit is decreed in terms of the settlement arrived at between the parties. The aforesaid application shall form part of the decree.

The decree sheet be drawn up accordingly.

9.

In view of the fact that the suit has been settled between the parties at an early stage, the Registry is directed to refund the entire court fees to the plaintiff, in terms of Section 16 of the Court Fees Act, 1870. 10.

The date already fixed in the matter, i.e. 2nd December, 2024 shall stand cancelled.
