Petitioner herein has, though, been granted furlough in terms of order dated 01.04.2026, his request seeking simultaneous release alongwith his co-convict/wife i.e. Poonam has been declined on 16.04.2026. The present petition has been filed seeking simultaneous release of the petitioner on furlough alongwith his co-convict/wife who has also been granted furlough vide order dated 09.04.2026.

Learned counsel for the petitioner seeks to rely upon the observations made by the learned Coordinate Bench of this Court in W.P.(Crl) 519/2025. He submits that earlier also, a similar prayer had been made by the same petitioner and this Court vide order dated 17.03.2025 acceded to his abovesaid request and permitted simultaneous release of the petitioner alongwith his wife/co-convict.

Copy of such order is also on record.

Petitioner also relies upon Rule 1224 of Delhi Prison Rules, 2018. The Note-1 attached to abovesaid rule reads as under:- "Note: - (1) Simultaneous furlough to co-accused convicts are W.P.(CRL) 1470/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. ordinarily not permissible. However, when co-accused convicts are family members, simultaneous release may be considered in exceptional circumstances only."

According to learned counsel for the petitioner, after the offence in question, both the convicts had married each other and they have twin daughters and in order to take requisite care of their such twin daughters, they seek simultaneous furlough.

Needless to emphasize that order dated 17.03.2025 passed by the learned Coordinate Bench in the earlier petition filed by the same petitioner is very specific and categoric, whereby the petitioner was granted simultaneous release alongwith his wife and, therefore, keeping in mind the observations appearing in the abovesaid order and also the rule position, the present petition is disposed of with the direction that the Competent Authority would permit simultaneous release on furlough to the petitioner herein. 7.

The other terms and conditions with respect to the grant of furlough would, however, remain the same.

Petition stands disposed of.
