By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 1075/2022 dated 18.11.2022, registered at P.S. Aman Vihar, District Rohini, Delhi, under Sections 285 and 337 of the Indian Penal Code, 1860, on the ground of settlement.

The FIR arises out of an incident in which five individuals sustained burn injuries when a fire broke out due to leakage of LPG during the preparation of food under the Mid-Day Meal Scheme. The said individuals, who were employees of the petitioners, have been arrayed as respondent Nos. 2 to 6 in the present petition. The Settlement Agreement dated 04.05.2026 has been executed with only four of the victims. Respondent No. 6 is neither a party to the settlement nor present or represented through counsel.

Mr. Rahul Mohad, learned counsel for the petitioners, therefore, seeks permission to withdraw the present petition with liberty to file a fresh petition in the event the petitioners are able to arrive at a settlement with respondent No. 6 as well.

The petition, alongwith the pending applications, is dismissed as withdrawn in terms of the above submissions.

It is made clear that the Court has not made any observation on the merits of the matter.
