This matter has been placed before the Court pursuant to an order dated 05.03.2024 passed by Mr. Vimal Kumar Yadav, learned Principal District & Sessions Judge, New Delhi District, Patiala House Courts, which reads as under:

"Ld. Counsels for both the accused persons have moved similar applications seeking exemption from personal exemption of the accused persons stating that both of them are out of station today and thus unable to appear today. In the facts circumstances explained, exemption applications qua both the accused persons are allowed. Perused the order dated 28.02.2024 of Ms. Anamika, Ld. MM-06, PHC, NDD wherein it is mentioned that one of the accused i.e. Dr. Udit Raj has been a Member of Parliament from 2014 to 2019. The courts dealing with the cases pertaining to MP/MLAs is at Rouse Avenue Courts. The power of Inter- District transfer of the cases is vested in the Hon'ble High Court of Delhi.

In view of the above, the present case file be sent to the Ld. Registrar General, Hon'ble High Court of Delhi, New Delhi for 04.04.2024 for appropriate directions.

The parties are directed to appear before the Ld. Registrar General, Hon'ble High Court of Delhi, New Delhi on 04.04.2024. Reading of the aforesaid order shows that case bearing CC No. 9822/2021, titled 'State v. Anil Kumar & Anr.' arising out of FIR No.150/2021 registered at PS: Parliament Street was listed before Ms. Anamika, MM-06, Patiala House Courts, New Delhi District on 28.02.2024 and the Court was of the view that since one of the accused, Dr. Udit Raj had been a Member of Parliament from 2014 to 2019, the case could be dealt only by the MP/MLAs Court at Rouse Avenue Courts and had, therefore, directed the matter to be placed before the Principal District & Sessions Judge, on 05.03.2024 at 2.00 pm for further orders. Since the power of inter-district transfer is vested in the High Court, the matter was sent to this Court for appropriate directions. 3.

Considering that cases pertaining to MP/MLAs are being adjudicated by the designated Court at Rouse Avenue Courts, present case being CC No.9822/2021 in case FIR No.150/2021 registered at PS: Parliament Street, titled 'State v. Anil Kumar & Anr.' is transferred to the Rouse Avenue Courts. It is directed that the case would be listed before the Principal District & Sessions Judge, Rouse Avenue Courts on 17.05.2024 for appropriate orders, with advance intimation to all the parties concerned. 4.

Copy of the order shall be sent by the Registry to both the Courts for information and necessary compliance.
