The petitioner has filed an application under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, before the Court of the Chief Judicial Magistrate ["CJM"], North-West District, Delhi. He seeks transfer of the proceedings to the Court of the CJM, North District, Delhi. 2.
Ms. Saumya Dwivedi, learned counsel for the petitioner, submits that the application relates to an alleged offence within the jurisdiction of Police Station Model Town, which falls under the North District, but was erroneously filed before the North-West District Court under the misconception that it pertained to Police Station Ashok Vihar. 3.
It appears from the order dated 03.02.2026 that, at this stage, no notice has been issued to the proposed respondents, and an Action Taken Report has been called for from the Station House Officer concerned. 4.

for the State, submits, upon instructions, that the State has no objection to the transfer, as the application was filed before the wrong Court. 5.
In view of the above, the transfer petition is allowed, and Complaint Case No. 1551/2026 pending before the Court of the CJM, North-West District, Delhi, is transferred to the Court of the CJM, North District, Delhi.

The petitioner may appear before the CJM, North District, Delhi, on 18.05.2026 for further proceedings.

It is made clear that this Court has not made any observations on the merits of the case.
