% 26.04.2019 CAV 434/2019 Learned counsel for the caveator has put in appearance. Accordingly, the caveat stands discharged.

FAO(OS) 86/2019 & CM APPL. 19326-19328/2019 After some arguments, Mr. Gupta, on instructions, seeks leave to withdraw the appeal. He, however, seeks a clarification that the learned Single Judge would be entitled to modify the directions given in the impugned order dated 01.02.2019, inter alia, on the ground that interim trustees appointed by the learned Single Judge vide the impugned order have not taken any effective steps since their appointment and in terms of the

orders passed by the learned Single Judge.

It goes without saying that since the suit is pending before the learned Single Judge and the appointment of trustees by the impugned order is only as an interim measure, it is open to the learned Single Judge to pass such further orders as it may deem necessary and to modify its order dated 01.02.2019 keeping in view the interest and object of the trust.
