% 02.03.2020 None appears on behalf of the appellant despite various calls. Per order dated 26.04.2019 the notice was issued to the respondent and subject to the appellant depositing 2/3rd of the decretal amount within four weeks from the said date the stay against the execution was granted. The appellant failed to deposit the said amount and even did not file the process fee for service of the respondent for 23.10.2019.

On 23.10.2019 yet again the directions was given to serve the respondent for filing the process fee. Even today the office note shows neither the process fee was filed nor the amount was deposited. None appears on behalf of the appellant since morning. It seems the appellant is not interested to pursue this appeal. In the circumstances, the appeal stands dismissed for nonprosecution.
