W.P.(C) 846/2018 & CM No. 3599/2018 (stay) Mr. Atul T.N., learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition with liberty to approach the learned Debts Recovery Appellate Tribunal, Delhi afresh, seeking modification of the impugned order dated 17th January, 2018 in Misc. Appeal No. 25/2018 in S.A No. 6/2018 (DRT-III, Delhi), in view of an order dated 3rd November, 2015, rendered by the Division Bench of this Court in W.P. (C) No 9803/2015, titled as "Suresh Chand Sharma vs. Punjab National Bank & Ors.", insofar as, it directs the substitution of an amount in money with a Fixed Deposit Receipt in favour of the respondent bank, if so advised. W.P.(C) 846/2018

Leave and liberty granted.

Petition is dismissed as withdrawn and disposed of accordingly. Pending application also stands disposed of.
