% 29.01.2018 Issue notice. Mr.Anil Soni, learned counsel appearing for respondent no.1 accepts notice.

Vide the present petition, the petitioner/institute has prayed for a direction to the respondent no.1 to notify the course/programme of Bachelor of Railway Engineering at Under Graduate Degree level and include the said degree course in the list of AICTE approved nomenclature of courses under the category of „Under Graduate Degree Course in Engineering and Technology‟ as notified in the AICTE Approval Process Handbook 2018-19. Mr.Amitesh Kumar, learned counsel for the petitioner submits that the petitioner has made atleast 20 representations to the respondent no.1 but till date no reply has been given to the petitioner except for an e-mail dated 12.04.2017 whereby they had informed the petitioner that the matter was still, being considered in consultation with the Railway Board.

He further submits that at this stage, he is only confining his prayer for a direction to the respondents to decide the representations made by the petitioner in a time-bound manner after consulting the respondent no.3/Ministry of Railways since the said course is exclusively dealing with Railway Engineering. He further submits that till date there is no degree course in Railway Engineering being conducted by any University in the country.

Mr.Anil Soni, learned counsel appearing for respondent no.1 on advance notice submits that in view of the limited relief being prayed for by the petitioner at this stage, there is no requirement of filing any counter affidavit by respondent no.1 or of issuing notice to the other respondents.

The respondent no.1 is directed to pass a reasoned and speaking order on the petitioner‟s representation dated 10.08.2017 within three weeks from today and communicate the same to the petitioner. Keeping in view the nature of the course, before passing the final order, the respondent no.1 would also take into consideration the views of respondent no.3.

The writ petition alongwith applications is disposed of with the above directions.
