% 03.02.2016 Property, involved in this writ petition, was sealed pursuant to the order passed by the Monitoring Committee. Petitioners seek de-sealing of the property.

In M.C. Mehta vs. Union of India and Others, (2013) 16 Supreme Court Cases 336, Supreme Court held that such persons, whose properties have been sealed, are at liberty to approach the Appellate Tribunal concerned, in terms of Sections 347-B/254/31-C of the MCD/NDMC/DDA Acts within 30 days for de-sealing. In view of the above, learned counsel for the petitioners seeks leave to withdraw the writ petition with liberty to approach the Appellate Tribunal for MCD within two weeks. Leave and liberty granted. In case appeal is

filed within two weeks, the same shall be deemed to have been filed within time and the Appellate Tribunal shall dispose of the same in accordance with law.

Writ petition is disposed of as withdrawn.
