This petition is preferred on behalf of the Petitioner under Section 29A(4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of mandate of the Arbitral Tribunal. 2.
From the pleadings and the documents on record, it emerges that Shri G.P. Thareja, retired District Judge, was appointed as the Sole Arbitrator to adjudicate disputes between the parties, who unfortunately expired before pronouncement of the Award. In light of this development, Petitioner preferred petition under Sections 14(1)(a) and 15(2) of 1996 Act, being O.M.P.(T)(COMM.) 114/2023 seeking appointment of substitute Arbitrator, which was allowed and by order dated 04.03.2025 substitute Arbitrator was appointed by the Court.

Learned counsels for the parties jointly submit that the arbitral proceedings are at the stage of final arguments and thus the mandate of the Arbitral Tribunal, which has expired on 17.09.2023, be extended. Accordingly, with the consent of the parties, mandate of the Arbitral Tribunal is extended by a period of 06 months from 05.05.2025 and period between 18.09.2023 to 04.05.2025 is regularised. 5.
Petition is allowed and disposed of in the aforesaid terms.
