% 17.07.2020 This hearing has been held through video conferencing. This petition has been filed by the petitioner inter alia stating that while filling up the choices for the second round of counselling for NEET PG 2020, the petitioner had opted for JLN Medical College Wardha-MD Paediatrics above the Medical Institute and Research Centre Jain MinorityMD Paediatrics, however, upon locking of these choices, it was shown in the reverse order. This was immediately brought to the notice of the respondent no. 2 by various representations, however, no response was received. On the other hand, the petitioner was allotted JLN Medical College Wardha-MD Paediatrics, while students having lower rank were allotted SBKS Medical Institute and Research Centre Vadodara Jain Minority- MD Paediatrics. The petitioner has placed reliance on the judgment dated 03.07.2020 of this Court in WP (C) 3636-2020 titled Duddugunta Vishnu Priya vs. Directorate General of Health Services & Anr. to submit that even in cases
of bona fide error, this Court has held that the meritorious student should not suffer.
On the other hand, the learned counsel for the respondents, on instructions, submits that presently only one seat of NRI category is available in the Medical Institute and Research Centre Jain Minority-MD Paediatrics. She further submits that the petitioner has already taken admission in the JLN Medical College and therefore, any relief to the petitioner at this stage would also cause that seat to go waste and would undo the entire counselling process..
Having considered the submissions made, as presently there is no seat available in the Medical Institute and Research Centre Jain Minority-MD Paediatrics, no relief can be granted to the petitioner. The petitioner has approached this Court with delay.
The petition is accordingly dismissed. There shall be no order as to costs.
