During the course of hearing, learned counsel appearing for the petitioner points out that when respondent-NDMC approached the Estate Officer seeking order of eviction under Section 5 of The Public Premises (Eviction of Unauthorised Occupants) Act, 1971, the application of the respondent-NDMC came to be rejected vide order dated 07.03.2024. He, therefore, submits that the respondent-NDMC, in view of the order passed by the competent authority, is under an obligation to comply with the same. 2.

The Court, at this stage, is of the considered opinion that the necessary recourse in accordance with law shall take place as a follow up action of the order dated 07.03.2024. The petitioner, however, is granted liberty to file a fresh writ petition, in case, his grievance is not mitigated. 3.
