The present writ petition has been directed against an award dated 14.08.2018 passed by the learned Presiding Officer, Labour Court-XIX, Dwarka Courts, Delhi in LIR No.534/2017.

A perusal of the impugned award would indicate that the petitionerworkman raised an industrial dispute and the Labour Commissioner has made the following reference for determination: "...Whether services of Sh. Devender Singh S/o Sh. Hari Singh, Age 30 years have been terminated illegally and / or unjustifiably by the management and if so, to what relief is he entitled and what directions are necessary in this respect...?" 3.
A statement of claim was filed, and although the respondentmanagement entered appearance, it did not lead any evidence. A perusal of the impugned award reveals that it has been passed on the basis of findings recorded by the Conciliation Officer, which refer to a resignation letter allegedly tendered by the petitioner-workman. letter was neither filed nor exhibited before the Labour Court. Furthermore, even the record of the conciliation proceedings itself was not available before the Labour Court.

In view of the aforesaid, this Court is of the considered opinion that the impugned award has been passed without considering the evidence, except the proceedings of the Conciliation Officer. Therefore, in the interest of justice, it is deemed apposite that the matter be remanded back to the Labour Court for fresh adjudication. The parties shall be at liberty to lead evidence before the Labour Court.

The writ petition is disposed of accordingly. 6.
The parties are directed to appear before the concerned Labour Court on 30.03.2026 at the first instance.
