The present petition has been filed by the Petitioners seeking issuance of appropriate directions to the Respondents to release the awarded compensation to the Petitioners in respect of the properties of the Petitioners, which were acquired vide award No. 02/2012-13 dated 4th February, 2013 & 2A/2016-17 dated 27th April, 2017, with respect to Khasra Nos. 106/2, 35/1111, 36/6/1/111, 6/11112, 6/112, 6/1/4, 6/1/5, 6/1/7, 7/5, 7/6, 7/7, 13, 14, 15/l; 15/3, 35-36110 and 60 village Bankner, Delhi. 3.

Respondent No.2/ LAC in this matter had stated that the file pertaining to the two awards in question in this case are missing and the concerned authorities are in the process of reconstructing the file. 4.

Thereafter, a similar request was also made on behalf of the LAC on 20th August, 2024 and the Court had granted one final opportunity to LAC to do the needful.

On 7th April, 2025, Mr. Pathak, ld. Counsel for the LAC had submitted before the Court that in order to fulfil the obligation arising out of the supplementary award 2A/2016-17 dated 27th April 2017, various correspondences have been made to Land and Building Department which is the beneficiary of the acquisition, however, the entire amount in terms of the award has not yet been disbursed by the MCD with the Government. 6.

Accordingly, upon hearing the submission made by the ld. Counsel for LAC on 7th April, 2025, the Court had issued the following directions: "4. List on 21.04.2025 to enable the learned counsel representing the Land Acquisition Collector, Land and Building Department of GNCTD and the Delhi Municipal Corporation/NDMC to complete their instructions as to why till date in terms of the supplementary award dated 27.04.2017,the amount of compensation has not yet been paid to the petitioner.In case clear instructions are not given in this regard, the Court may be compelled to summon the officers concerned to ensure that compensation in terms of the supplementary award dated 27.04.2017 is paid to the eligible persons.

Subsequent to the said directions of the Court dated 7th April, 2025, this Court, on 11th July, 2025, noted as under: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

"3. Even after expiry of a period of about 03 months, from the date of the said order, the compensation pursuant to the supplementary award dated 27.04.2017 has not yet been paid to the petitioners.

4. Learned counsel representing the MCD, however, on instructions, submits that the necessary administrative approval is being sought, process for it is likely to be completed within 02 weeks. He states that he has personally taken up the matter with the officers concerned, and by using his good offices he shall make all his endeavors to ensure that the payment is made within 04 weeks thereafter. The said statement has been made in presence of the officer of the MCD,namely Mr. Varun, Executive Engineer (Project)Narela Zone.

5. We thus direct that the payment of the compensation shall be made within 06 weeks from today,failing which the officer who is present in Court today shall again appear before the Court on the next date of hearing for assistance.

Pursuant to the above stated directions issued by the Court, on 8th September, 2025, it was stated that certain demand drafts were received towards satisfaction of compensation/part payment of compensation to which the Petitioners are entitled. Accordingly, on the said date, it was directed that the concerned Executive Engineer shall deposit the entire amount due to be payable to the Petitioners to the LAC and the same shall be released to the Petitioners be the LAC.

Today, Mr. Pathak, ld. Counsel for LAC submits that the amount has now been received, including the principal amount and the interest. He further submits that part payment towards compensation has already been made to the Petitioners.

In addition, he submits that there is a change of signatory in the Bank Account due to which there has been some delay. 11.

Thus, it is assured that upon undertaking necessary procedural formalities, that the payment shall be released to the Petitioners by 31st March, 2026.

Accordingly, the present petition is disposed of in said terms. Pending applications, if any, are also disposed of.

The Petitioners are permitted to approach the Court if payment is not received by them.
