O R D E R

By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the following reliefs: "a) Direct expeditious disposal of Criminal Case No. 5940/2021 arising out of FIR No. 409/2019 registered at P.S. Swaroop Nagar under Sections 420/34 IPC, pending before the Court of L.d. JIMFC 07, North District, Rohini Courts, Delhi, within a time-bound period preferably 3 months; b) Direct Respondent no 1 final submissions of any further reports/ supplementary chargesheets if any in Criminal Case No.5940/2021 arising out of FIR No.409/2019 registered at P.S. Swaroop Nagar under Sections 420/34 IPC, pending before the Court of Ld. JMFC-07, North District, Rohini Courts, Delhi preferably within 30 days. c) Direct Respondent no. 1 for strictly adherence with the previous directions passed by this Hon'ble Court that the case shall not be investigated below the rank of Inspector of DIU."

Pursuant to discussions inter se the learned counsel for the petitioner along with learned APP for the State and the responsible Officers of Delhi Police, it has been agreed and undertaken by way of an amicable resolution as under:

a) ACP (DIU) will monitor the case personally.

b) Inspector Rajesh will appear before the learned Trial Court on each date till his posting in DIU Cell, and he will be followed in succession in terms of the order dated 18.12.2020 passed by this Court in W.P.(CRL) 864/2020.

c) Priority letter will be written to F.S.L to give a conclusive report within a period of two months.

In view of the aforesaid, considering the nature of the proceedings as also since the FIR is pertaining to the year 2019 as also considering the progress therein, the learned Trial Court is requested to conclude the proceedings arising out of FIR no.409/2019 as expeditiously as possible, preferably on or before 31.08.2027, keeping in view the board position of the pendency and the current roster before it. 4.

In view of the aforesaid directions, since, as per learned counsel for the petitioner he is satisfied and there is nothing remaining therein, the present petition, along with the pending application, is disposed of. 5.

A copy of this order be sent to the learned Principal District and Sessions Judge, North District, Rohini Courts, Delhi for compliance.
