This petition has been filed challenging the order dated 13th February, 2019 by ASJ (East), Karkardooma Courts, Delhi which reduced interim maintenance in the proceedings under the Domestic Violence Act from Rs. 9,000/- per month (granted by MM, Mahila Court-01, East Dist., Karkardooma Court, Delhi) to Rs.2,000/- per month. It is stated that the final maintenance order has been passed by order dated 21st July, 2022 whereby Rs.5,300/- per month has been awarded in favour of wife/petitioner.

Counsel for the respondent No.2/husband states that they have not challenged the said order and are committed to pay Rs.5,300/- per month. Needless to state that the same shall be paid regularly in addition to paying up the arrears to the petitioner/wife.

On this basis, counsel for the petitioner seeks to withdraw the petition with liberty to challenge the final maintenance order, if so instructed. 4.

Leave and liberty granted.

Any petition filed challenging the final maintenance order will be adjudged in accordance with law, considering that it has not been assailed for the last two years.

Accordingly, petition is dismissed as withdrawn. 7.
