In compliance of the order dated 4th September 2020, the records have been shared with us and are even today available at the residence of one of us (Justice Asha Menon) at the time of hearing.

On perusal of the aforesaid records, we were/are satisfied that no injustice has been caused to the petitioner and the promotions have been done without any bias in favour of any of the persons or against the petitioner, who are all worthy members of the Armed Forces, guarding the country in this crucial time. 3.

particulars, shared the information aforesaid gathered by us from the record, with the counsel for the petitioner. During the hearing, the counsel for the respondents, under instructions has also stated that the Annual Confidential Report (ACR) for the year 2018 has not been taken into consideration.

The counsel for the petitioner states that petitioner has gracefully agreed to the petition being closed, in terms of order dated 4th September 2020 and today's order.

The petition is accordingly closed. We appreciate the conduct of the petitioner as a disciplined officer of the Armed Forces, of showing due respect to the decision making in the records and in not indulging in unnecessary litigation which is likely to lead to acrimony and disharmony in the force.
