The petitioner has approached this Court under Article 226 of the Constitution, challenging a transfer order dated 13.03.2025, by which he has been transferred from the post of Chief Manager (Refinery-Coord), Paradip RC, to the same post in Barauni, Bihar. 2.

Mr. Ratneswar Das, learned counsel for the petitioner, submits that the petitioner had opted for a transfer to three locations in the States of Assam and Arunachal Pradesh as his wife is posted as a doctor with the Government of Arunachal Pradesh. He submits that this is in line with the Transfer Policy of the respondent pertaining to posting of spouses. three calendar years, which is the normal tenure prescribed under the Transfer Policy.

Mr. Das submits that the petitioner's children are, at present, in Class IX and Class X, studying in Paradip, and he has opted for a transfer to a place close to where his wife is posted, but a transfer to any other place at this juncture would be disruptive both to the children's academic progress and the overall stability of the family environment. 4.

Pursuant to the order dated 09.04.2025, Mr. V.N. Koura, learned counsel for the respondent, has taken instructions and submits that the respondent will consider the petitioner's representation and pass a reasoned order within three weeks from today. 5.

In view of the above submission, the writ petition is disposed of with a direction that the petitioner may make a representation to the Executive Director (HR), Marketing Division of the respondent's Head Office in Mumbai, within a period of one week from today. 6.

As submitted by Mr. Koura, the respondent will pass a reasoned order within three weeks thereafter.

It is further directed that, in order to enable consideration of the matter in these terms, status quo will be maintained as to the petitioner's posting until the petitioner's representation is decided, and for a period of 10 days thereafter.
