% 20.07.2020 The petitioner's grievance is that respondent No. 3, who the petitioner had engaged for undertaking some construction, has not completed the work and has also misappropriated the monies paid to him. 2.

Mr. Milan Laskar, learned counsel for the petitioner submits that in this regard the petitioner has made complaints to the police at various levels, including written complaints dated 24.01.2020, 16.02.2020 and 14.05.2020, but to no avail.

Mr. Ranbir Singh Kundu, learned ASC appearing on behalf of the State on advance copy submits, that in fact the local police did enquire into the matter, but had to close the case since it is essentially a civil dispute arising from a contract and has no element of criminality.

In the circumstances, Mr. Laskar wishes to withdraw the present petition, with liberty to adopt such remedies, at civil and/or criminal law, as may be available to the petitioner.

Accordingly, without commenting on the merits of the matter, the present petition is dismissed as withdrawn, with liberty as prayed for. 6.
