At the outset, learned counsel for respondent no.1, upon instructions received from the respondent no.1 in terms of the last order submits that though an application under Rule 34 of the Trade Marks Rules, 2017 filed by an applicant is not qua opposition proceedings, however, considering the nature involved in the present opposition proceedings, if an application under Rule 34 of the Trade Marks Rules, 2017 is filed by the petitioner, the same will be disposed of at the earliest, preferably within a period of three months from the date of filing of the said application. 2.
Learned counsel for the petitioner submits that the aforesaid application shall be filed within a period of one week from today. 3.
Accordingly, the present petition, alongwith pending applications is disposed of with the aforesaid directions.
