The instant writ petition has been filed by the Petitioner under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 to trace and produce the body of the daughter of the Petitioner, who is stated to have been missing from her house since 06.03.2025.

Since the girl is a minor of about 17 years of age, an FIR bearing No. 119/2025 Section 137(2) Bharatiya Nyaya Sanhita, 2023 dated 07.03.2025 has been registered at PS Bawana, Delhi. 3.

stated that with the efforts of the Police, the minor girl was recovered from H. No. 104/610161, Ram Baghwala, Atapur, Hyderabad. 4.
It transpires that the girl is in love with one Akash @Ramlakhan @Bhola S/o Jagdish. The girl was about three months pregnant when she ran away from the house and now she is approximately five months pregnant.

The girl is present in the Court and she states that she is, in fact, in love with Akash and that she is married to him and wants to stay with him.

She also states that she is not willing to go to her parents' house as she apprehends that her parents are against her marriage with Akash.

Keeping in mind, the wishes of the girl, who is about five months pregnant, this Court is inclined to direct the State to accommodate the girl and her unborn child at Nirmal Chaya, Harinagar.

It is also stated that a case under Section 64 BNSS and Section 6 of The Protection of Child from Sexual Offences, 2012 has also been added against Akash @Ramlakhan @Bhola s/o Jagdish and he has been arrested and sent to judicial custody on 07.04.2025. In case the boy is released on bail, and if the girl wants to meet the boy, there should be no impediment for the same.

Since the girl is approximately 5 months pregnant, the Nirmal Chaya and the State are directed to ensure that adequate facilities and proper treatment are provided to the girl to ensure a safe delivery. 10.
