This hearing has been done through hybrid mode. 2.

The present petition under Article 226 of the Constitution of India read with Section 528 of the BNSS seeks the following prayers: - "a) It is, therefore, prayed with folded hands to the Hon'ble Court to be graciously pleased to kindly grant parole to the petitioner in FIR 484/2003 u/s 302/34 IPC registered at P.S. Adarsh Nagar for a period of 10 days to arrange funds and taking Care of his wife and the petitioner would surrender on the date specified by the Hon'ble Court.

b) Any other writ or order which this Hon'ble court may deem fit just and proper in the facts and circumstance of the case, in the interest and furtherance of justice."

Vide order dated 09.04.2025, this Court granted parole to the present petitioner till today, the said order reads as under: - "4. The present petitioner was granted parole vide order dated 10.03.2025 in W.P. (CRL) No. 793/2025 for the purpose of his wife's urgent surgery which was scheduled for 12th March, 2025. Thereafter, the petitioner again sought an extension of parole which The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

was granted vide order dated 21st March, 2025 in W.P. (CRL) No. 916/2025 on the ground that the surgery was to be performed on 24th March, 2025 and noting that no further extension of the parole shall be granted to the petitioner on the ground of his wife's surgery.

Learned counsel for the petitioner submits that the surgery scheduled for 24th March, 2025 could not take place as the concerned surgeon Dr. Pritt Singh Chawla had to go for an emergency to the USA and the said surgery has now been scheduled for 12th April, 2025. It is further pointed out that the petitioner surrendered before the concerned Jail Superintendent on 30th March, 2025."

Learned Standing Counsel handed up a status report dated 15.04.2025 in Court today and the same is taken on record. The said status report verifies the fact that the surgery of the wife of petitioner is to be performed on 15.04.2025 and the second surgery will be considered after the histopathology report of the tissue which as per the concerned doctor takes about 5-8 days to come.

Learned counsel appearing on behalf of the petitioner on instructions submits that the biopsy has been conducted today, i.e., 15.04.2025, and the next procedure would be conducted after the report has been received. 6.

In view of the aforesaid circumstances, the parole granted to the present petitioner vide order dated 09.04.2025 is extended for a period of 2 weeks on the same terms and conditions.

The petition stands disposed of.

The petitioner after the expiry of 14 days shall surrender before the concerned Jail Superintendent.

Copy of the order be communicated to the concerned Jail Superintendent.
