The present writ petition has been filed seeking a direction to respondent no.1/ MCD to demolish the unauthorized construction carried out by the respondent no.2 at property bearing no. RZ-147, Indira Park, Ward No. 106, Uttam Nagar, New Delhi-110059 (hereinafter 'subject property').

Counsel appearing on behalf of the respondent no.1/ MCD submits that the subject property has been booked on 27th April, 2026 and a show cause notice has been issued on the same date regarding unauthorized construction. He submits that after giving a show cause notice, no construction is being carried out in the suit property. 3.

directing respondent no.1/ MCD and respondent no.3/ SHO P.S. Bindapur to take action in accordance with law.

All rights, contentions and legal remedies of the respondent no.2 are kept open.
