The limited prayer in the present petition is for issuing directions to the learned Trial Court for expediting the trial in SC No. 55/2020 titled as "STATE VS KAPIL MANN @ KALLU" in F.I.R. No. 401/2019 registered at P.S. Narela, Delhi under Sections 302/120B/34 IPC & 25/27 Arms Act, which is stated to be pending before the learned ASJ/Special Judge, North, Rohini Courts, Delhi.

The learned counsel for petitioner submits that petitioner is in custody since 15.09.2019 and till date only 4 witnesses out of 75 witnesses cited by the prosecution have been examined and at this stage, it may take years to conclude the Trial.

It is further submitted that, previously also, he filed a similar petition and the directions were issued by this Court to frame charges, vide order dated 12.03.2024. Considering the fact that petitioner is in custody since more than 5 years as also the fact that the trial is still at a nascent stage inasmuch as lot of witnesses is yet not examined, the petition is disposed of with direction to the learned Trial Court to grant short adjournment and make best possible endeavour to expedite the disposal of the case. 5.

The Trial Court is further directed to examine material witnesses at the earliest.

Both sides are also requested to render their due cooperation to the learned Trial Court in getting the trial expedited. 7.
