The present appeal under Section 96 of the CPC seeks the following prayers:

"i. allow the present appeal with cost.

ii.

set-aside the impugned Judgment and Decree dated 29.10.2009 in case suit bearing no. 813/08/06, titled M/s Argent Leasing & Finance Pvt. Ltd. Vs. Suresh Singh & Anr. passed by the court of Sh. Surinder S. Rathi ADJ, (Central)-07, Delhi and dismiss the suit accordingly.

iii. pass such further and other orders as this Hon'ble Court may deem fit and proper."

There was no appearance on behalf of the appellant on previous dates of hearing as well, i.e., 15.04.2025 and 08.10.2025. 5.
