During the course of arguments, learned counsel for the petitioner submits that, at this stage, the petitioner is not pressing the present petition, as his application under Order VIII Rule 1 of the Code of Civil Procedure, 1908 (CPC), is still pending adjudication before the learned Trial Court. It is further submitted that the present petition be disposed of as withdrawn with liberty to move an appropriate application before the learned Trial Court for consideration of the said application.
