This is a petition under Section 528 read with Section 529 BNSS, 2023, seeking directions for expeditious disposal of Complaint Case No. 419/2010, pending before the learned Judicial Magistrate, First Class-05 Shahdara District, Karkardooma Courts.

Mr. Ayushman Aeron, learned counsel, appearing for the petitioner, submits that pursuant to the filing of Complaint Case, by the orders of Court, FIR bearing No. 405/2011 was registered by the Police. It is stated that final report has since been filed in the year 2015. Charges were framed on 05.04.2019.

Learned counsel for the petitioner states that accused persons filed Criminal Miscellaneous bearing Nos. CRL.M.C. 1919/2024 and CRL.M.C. 1957/2024, which are pending before this Court but there is no stay of trial Court proceedings.

It is submitted that complaint was filed in the year 2010 but till date, not a single witness has been examined.

Learned APP appearing on behalf of State submits that delay has occurred because of multiple litigations resorted by parties. 6.

Be that as it may, considering the fact that complaint was initially filed in the year 2010 and there is not much progress in the matter, learned trial Court is directed to make all possible endeavour to expeditiously dispose of the case by discouraging unnecessary adjournments. Parties and respective advocates are also directed to cooperate with the trial Court in this regard.

The petition accordingly stands disposed of.
