Petitioner herein is aggrieved by order dated 16.05.2023 whereby the learned Trial Court has permitted prosecution to put some leading questions to PW-11 Sh. Avijit Chattaraj.

However, there is significant development thereafter as the case in question i.e. SC No.2/2022 titled State vs. Sumeet Suri & Ors. emanating from FIR No.125/2010 registered at PS EOW South East for offences under Section 120B/409/420/468/471 IPC has already been decided by the learned Special Judge and the accused has been held guilty and convicted on 25.09.2025 and order on sentence has been passed on 09.10.2025. 3.
Learned counsel for the petitioner, in all fairness, submits that such conviction and order-on-sentence have already been challenged by filing an appeal and such appeal i.e. Crl.A.1434/2025 is, presently, pending adjudication before the Bench presided over by Hon'ble Ms. Justice Chandrasekharan Sudha and the sentence of the appellant therein i.e. CRL.M.C. 3738/2023 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. petitioner Sumit Suri has already been suspended. 4.
Learned counsel for the petitioner submits that the grievance raised in the present petition has also been taken in the abovesaid appeal also. 5.
In view of the above, learned counsel for the petitioner, without prejudice to his rights and contentions, does not press the present petition with liberty to agitate the said aspect related to impugned order dated 16.05.2023 in the abovsaid appeal.

The petition is disposed of, as not pressed in abovesaid terms. 7.
Pending application also stands disposed of in aforesaid terms.
