1. The limited issue that arises in this appeal is whether the learned Single Judge was right in holding that it would open to the Respondent Institute to prescribe a higher qualification for the post of Director than that stipulated by the AICTE.

2. The development subsequent to the filing of this appeal is that the Respondent No. 1 Institute is now a statutory body. The question of a erstwhile Director of the Respondent No. 1 Institute automatically becoming LPA 93/2018 Page 1 of 2

its Vice-Chancellor (which is the post that has replaced the post of a director), does not arise. Consequently, there is no apprehension that the person selected as Director earlier pursuant to the advertisement issued by the Respondent No. 1 could continue as Vice-Chancellor of the Respondent No. 1 Institute. The Court has in fact been shown a copy of the order dated 26th September 2018, by which a Vice-Chancellor has been appointed. This Court is not called upon in these proceedings to express any opinion on the validity of such an appointment.

3. In view of above developments, this appeal does not survive and is accordingly dismissed. The interim order is vacated. S.MURALIDHAR, J.
