The present petition has been filed by the plaintiff seeking that the suit captioned 'Institution for the Blind v. Bansi Lal Sharma & Ors.: CS No.1365/2018' be transferred to be heard by the court of Additional District Judge, along with suit captioned 'Institution for the Blind v. Deepak Sharma and Ors.: CS No.10919/2016'.

The learned District Judge had recused from hearing the said transfer petition (T.P. Civil No.10/2019) and, therefore, the matter has been placed before this Court.

This Court has now been informed that the learned District Judge has since been transferred and a new incumbent has taken charge as a District and Sessions Judge, South-East, Saket Court Complex.

In the said circumstances there is now no impediment for the application for transfer to be decided by the said court on merits. 3.

In view of the above, the present matter is remanded to the District and Sessions Judge, South-East, Saket Court to be heard on merits. 4.

The Registry is directed to send the entire record to the concerned Court. The parties are also directed to appear before the concerned Court on 13.08.2019.
