The accused/applicant seeks regular bail in case FIR No. 281/2025 of PS Dayalpur for offence under Section 109(1) BNS. 2.
Broadly speaking, allegation against the accused/applicant is that he inflicted multiple stab blows on the victim, who fortunately survived. The incident was captured in CCTV footage which has been shown by the Investigating Officer in his mobile phone.

Learned counsel for accused/applicant submits that regarding the incident, a cross FIR also was registered and that despite number of adjournments, the prosecution is not producing the injured in the witness box before the trial court.

Learned APP for State, assisted by IO/SI Shiv Dayal, accepts notice and submits that the injured shall be produced for his testimony before the trial court on 02.06.2026.

Under these circumstances, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before trial court after recording of testimony of the injured. 6.
As requested, the bail application and the accompanying application are dismissed as withdrawn with liberty as sought. The learned trial court is requested to conclude recording of testimony of the injured as expeditiously as possible, but positively within one month.
