Witnesses Dr. Sumita Dass Majumdar, Archivist, from National Archives and Mr. M. P. Singh, Assistant OSB, DDA are present. Dr. Sumita submits that the summoned record is not available in her office. Copy of letter addressed to AOJ placed on record. Copy supplied to learned counsel for plaintiff and to defendant No.2. Learned counsel for plaintiff submits that to avoid inconvenience to the witness from DDA, he may be examined. He is a formal witness. He is examined as PW3 and discharged.

PW3 has filed photocopies of the documents as Ex.PW3/A to Ex.PW3/C. Learned counsel for plaintiff submits that the suit properties are situated in North and West District. Learned counsel for plaintiff further submits that the suit may be sent to West District.
