J U D G M E N T

MANMOHAN, ACJ: (ORAL) 1.

The present petition has been filed under Article 226 of the Constitution of India seeking directions to the Respondents to strictly enforce implementation of the provisions of Employment of Manual Scavengers and Construction of Dry Latrine (Prohibition) Act, 1993, inter alia, seeking enforcement of fundamental rights guaranteed under Articles 14, 17, 21 and 23 of the Constitution of India. 2.

The Union of India has filed a status report through Ministry of Social By:Rashmi Dabas 18:10:42 W.P.(C) 845/2011

Justice & Empowerment (MoSJE) on 31st August, 2023 on the eradication of Manual Scavenging and Insanitary toilets.

The Supreme Court in its recent judgment dated 20th October, 2023 passed in Balram Singh v. Union of India and Ors.1 has authoritatively dealt with the issues raised in the present petition and has passed comprehensive directions to the Union of India, all States and Union Territories in paragraph 104. With the passing of the said directions, the reliefs sought in the present petition also stands satisfied. 4.

The learned Standing Counsel for Union of India states that the Union remains bound to comply with the directions issued in the aforesaid judgment of the Supreme Court and relies upon the steps taken as reported in the status report dated 31st August, 2023. 5.

In view of the above, the present petition along with pending applications, if any, stand disposed of.
