By way of present application filed under Section 482 read with Section 439(2) Cr.P.C., the petitioner seeks cancellation of bail granted to respondent No.2 by this Court vide order dated 22.11.2022. 2.

The only ground taken by the petitioner is that respondent No.2 after being granted the bail order, has not honoured the MOU which was entered into between the parties on 10.12.2022.

A perusal of the material placed on record would show that while bail order was passed on 22.11.2022, the parties subsequently entered into an MOU on 10.12.2022 and the bail order was passed subject to the applicant paying Rs.10 lacs to the complainant.

Learned counsel for the complainant submits that though the amount was received, however, the same was after a delay. 5.

Considering that the MOU, the default of which is sought to be made the ground for cancellation of bail, was entered into subsequent to the passing of the bail order, I find no merit in the present application.
