The present writ petition has been filed alleging unauthorized encroachment/construction of 3rd and 4th floors of DDA Flat No. 215, F-7A, Sector-16, Rohini-89 against the standard plan. 2.
It is the case of the petitioner that the respondent no. 5 has grabbed the second floor terrace entirely and common space and has illegally constructed 3rd and 4th floor on the same, which is totally illegal and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that as per the standard plan, the building consisted of only ground, first and second floor.

Issue notice.

Notice is accepted by learned counsels appearing for respondent nos. 1 to 4.

Learned counsel appearing for respondent nos. 2 and 3 i.e., Municipal Corporation of Delhi ("MCD") submits that the flats in question have been inspected today morning i.e., 15th April, 2025. He submits that there is no ongoing construction. However, there is encroachment on the ground floor, as well as unauthorized construction in the building in the form of 3rd and 4th floor. He submits that action shall be taken by the MCD as per law. He submits that the MCD is already in the process of issuing show cause notices to the concerned persons.

The aforesaid statement made on behalf of the MCD is recorded and the MCD is bound by the aforesaid statement.

Accordingly, it is directed that the MCD shall take requisite action against the unauthorized construction, after following the due process, in accordance with law.

The action taken by the MCD shall be duly uploaded on the website of the Special Task Force ("STF") as constituted by the Supreme Court. 10.
In case, the petitioner is aggrieved by any non-action on the part of the MCD or other authorities, the petitioner is at liberty to approach the STF, which shall ensure that requisite action is taken. 11.
