Considering the nature of the disputes involved, learned CGSC appearing for the Registrar of Trade Marks submits at the outset, that though the O-3 Notice dated 19.03.2018 as uploaded on the official website of the said respondent is available, however, despite searching for the tracking report thereof, the same is not traceable. 2.

Accordingly, without going into the merits of the dispute involved, learned CGSC submits that the petitioner herein shall be allowed to file an application for seeking restoration of the trademarks application no. 1694972 in Class 5 as also an application for renewal along with requisite fee within a period of two weeks.

Learned counsel appearing for the petitioner submits that the appropriate Form-TM-R shall be filed within a period of four weeks.
