% 19.02.2018 Crl.M.A.2004/2018 (exemption) Exemption is allowed subject to all just exceptions. 1.

The petitioner seeks quashing of FIR No.654/2015, Police Station New Ashok Nagar. The subject FIR was initially registered under Section 365 IPC against one Deepak.

The allegations in the FIR are that the said Deepak had kidnapped petitioner (the daughter of complainant).

Subsequently, when the said Deepak and the petitioner were traced

out, it transpired that the petitioner is a major and, she out of her own free will had left her parental home and had gone with the said Deepak with whom she had subsequently solemnized her marriage. 3.

One of the allegations raised by the complainant was that his daughter had taken away Rs.4,50,000/- lakhs. The petitioner admitted that she had taken only a sum of Rs.3,60,000/-, out of which, some amount had been spent and the balance sum of Rs.70,000/-, which was available with her, was seized by the Investigating Officer. 4.

Subsequently, in the subject FIR, charge sheet has been filed against the petitioner (i.e. daughter of the complainant), under Section 380/411 IPC.

By this petition, the petitioner seeks quashing of the FIR No.654/2015 under Section 380/411 IPC based on a compromise entered into between complainant and petitioner on 10.01.2018.

The complainant is present in Court in person, represented by a counsel and is identified by the Investigating Officer. He submits that he does not wish to press the complaint any further and has no objection to the quashing of the FIR.

In view of the fact that the parties have fully and finally settled their disputes and the respondent No.2 does not wish to press the complaint any further and the fact that a compromise deed dated 10.01.2018 has been executed between the parties and the fact that the

complainant is the father of the petitioner, and in the interest of justice, it would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

In view of the above, FIR No.654/2015 under Section 380/411 IPC, Police Station New Ashok Nagar and consequent proceedings emanating there from are quashed. 9.
