% 13.11.2025 Pursuant to what was recorded in order dated 11.11.2025, Mr. R.P.S. Sirohi, learned counsel is present on behalf of the appellant alongwith the appellant.

Mr. Animesh Sinha, learned counsel appearing for the respondent submits, on instructions, that the respondent is willing to grant to the appellant a reduction of 3% on the interest component of the money decree, and to settle for a rate of interest @ 6% per annum instead of the 9% per annum awarded by the learned trial court. 3.
Mr. Sirohi submits, that in compliance of order dated 24.05.2022 passed in the present proceedings, the appellant has already deposited 75% of the decretal amount i.e., a sum of Rs.6 lacs in this court; and that the said sum alongwith interest accrued thereupon be released to the respondent; and that the interest at 6% per annum be calculated only on the balance Rs. 2 lacs for the proportionate period. Upon making that calculation, the total amount due from the appellant to the respondent comes to Rs. 12,76,877/-.

Counsel for the parties submit that parties are willing to have the present appeal disposed-of in the above terms. 6.
In view of the above, the present appeal is disposed-of with the following directions:

The Registry is directed to release in favour of the respondent the amount of Rs. 6 lacs lying deposited in court alongwith upto-date interest, within 03 weeks of the respondent approaching them for the purpose, under written intimation to the appellant. 6.2.
Furthermore, the appellant is directed to pay to the respondent the balance amount remaining out of Rs. 12,76,877/-, after deducting the amount released to the respondent by Registry, within 04 weeks of the Registry communicating to the appellant the sum so released.

The appeal is disposed-of in the above terms. 8.
