% 19.02.2018 Petitioners are seeking quashing of the present FIR being FIR No. 0810/2016 registered at PS Mukherjee Nagar under Section 498A/406 r/s Section 34 of the IPC on the complaint of respondent No. 2. Petitioner No. 1 and respondent No. 2 had got married according to Hindu Rites on 24.04.2012. They have been living separately since October 2013. No child was born out of their wedlock. Parties have now settled all their disputes. They have been divorced by a decree of mutual consent on 10.10.2017. Petitioner No. 1 has agreed to pay a sum of Rs. 15 lakhs to respondent No. 2 in full and final settlement of all claims out of which Rs. 8 lakhs already stands paid. A sum of Rs. 7 lakhs has been paid in court today by way of demand draft to respondent No. 2. Respondent No. 2 is

present in person. Her presence has been identified by her counsel as also by the investigating officer. Parties endorse the terms of the settlement which have been noted supra.

This is a fit case where the prayer made in the petition should be granted. Accordingly, to secure the ends of justice, the present FIR No. 0810/2016 registered at PS Mukherjee Nagar under Section 498A/406 r/s Section 34 of the IPC and all other proceedings emanating there from are quashed.

Petition disposed of in the above terms.
