At the outset, learned Counsel for the Respondent submits that so far as the decree which forms the subject matter of the Impugned Order, the same was challenged by the Petitioner in RCA No.3-2011 captioned Anil Kumar Mishra v. Sh. Rajender Kumar Yadav.

Learned Counsel for the Petitioner, on instructions, submits that he seeks permission to withdraw the present Petition. Liberty is however sought to take appropriate steps.

The Petition is accordingly dismissed as withdrawn. The liberty as sought for is granted albeit in accordance with law.
