CRL.M.C. 925/2018 1.

By this petition, the petitioner seeks quashing of FIR No.988/2015 under Section 135 of the Indian Electricity Act, Police Station Mehrauli, based on a settlement.

Subject FIR was registered consequent to a raid conducted at the premises of the petitioner.

Initially, Bill of Rs.2,42,316/- was raised.

Thereafter, the matter was settled before the Permanent Lok Adalat at Rs.39,599/-. When the matter was placed before the Trial Court, the Trial CRL.M.C.925/2018

Court was of the view that the settlement was arrived at a very low amount. Accordingly, parties were once again relegated for settlement. Finally, an amount of Rs.1,08,200/- has been settled.

The entire amount of Rs.1,08,200/- has been paid and No Due Certificate has been issued by the respondent/complainant on 11.02.2018. 4.

Learned Counsel appearing for the Respondent No. 2 submits that the said respondent does not wish to prosecute the complaint and consents to the quashing of the subject FIR.

In view of the fact that the Petitioner has paid the settled amount and Respondent No. 2 does not wish to prosecute the complaint, it would be expedient and in the interest of justice that the subject FIR and the proceedings emanating therefrom are quashed.

Accordingly, the subject FIR No.988/2015 under Section 135 of the Indian Electricity Act, Police Station Mehrauli as well as the consequent proceedings arising therefrom are quashed. The petitioner shall deposit cost of Rs.10,000/- with the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi, within a period of two weeks from today. Receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of three weeks from today.
