This is the petition praying for allowing the petitioner to lead defence evidence in the complaint case no. 467250/2016 which was closed vide order dated 29.01.2019.

Learned counsel for respondent states that he has no objection if the petition is allowed but petitioner be directed to lead defence evidence positively on 11.11.2010 when the case is listed. 3.

Learned counsel for the petitioner states that defence evidence will be positively led by the next date of hearing which is now listed for final arguments on 11.11.2019 before the learned MM. 4.

Heard. In view of the above submission, the petition is allowed. The impugned order dated 29.01.2019 is set aside with the direction that petitioner will appear before the learned MM positively on 11.11.2019 and

in case the petitioner cannot lead defence evidence on 11.11.2019 for any reason, the same should be completed within the period of another 30 days thereafter.
