O R D E R

% 24.07.2020 (hearing through Video Conferencing) Vide the present application, the applicant seeks the grant of interim bail for a period of 45 days in relation to FIR No.107/2018, PS Model Town under Sections 392/394/395/397/482/411/34 of the Indian Penal Code, 1860 submitting to the effect that the applicant has tested for COVID-19 as per the result dated 16.07.2020. Learned counsel for the applicant however submits that in terms of order dated 13.07.2020 of the Hon'ble Full Bench of this Court in W.P.(C)3037/2020, the applicant be allowed to be released on interim bail till 31.08.2020. The said prayer is not opposed on behalf of the State in view of the status report dated 23.07.2020 that has been submitted on behalf of the State under the signatures of Inspector Dinesh Kumar, SHO PS Model Town which indicates that a verification has been conducted at the concerned Dispensary, Sarai Rohilla and the concerned doctor has opined that as per record at serial No.SRD/24, the applicant tested positive

by Rapid Antigen test on 16.07.2020 and as per ICMR guideline he was recommended for home isolation for a period of 17 days w.e.f. 16.07.2020.

It has been submitted on behalf of the applicant by the learned counsel for the applicant that the applicant has to surrender on 10.07.2020 in view of order dated 09.07.2020 of this Court in Bail Appl. No.1525/2020 but he was unable to surrender, in as much as, the jail authorities have not permitted him to surrender in view of his having symptoms of COVID-19.

In the circumstances, in view of the status report that has been submitted on behalf of the State and the order dated 13.07.2020 of the Hon'ble Full Bench of this Court in W.P.(C)3037/2020, the applicant is allowed to be released on interim bail till the date 31.08.2020 on submitting a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the learned Trial Court with the directions that:-  he shall keep his mobile on at all times;

 he shall drop his location on the Google map so that his location is available to the Investigating Officer;

 he shall mark his appearance telephonically to the Investigating Officer on every 7th day during the period he is on interim bail;  he shall make no contact with the prosecution witnesses;  he shall commit no offence whatsoever and in the event of his being involved in any other case and lodging of FIR or DD entry against him, the State shall bring the same to the notice of the Court forthwith. The application is disposed of.
