O R D E R

% 06.01.2016 Challenge in this appeal is to the order dated 20.12.2013 passed by the Family Court on an application filed by the appellant (wife) under Section 125 of the Code of Criminal Procedure.

After some hearing in the matter, counsel for both the parties agree that the impugned order may be set aside and the matter may be remanded back to the Family Court for fresh hearing. The respondent, however, agrees to continue to pay Rs. 4,500/- p.m. towards maintenance to the appellant and her child. The appeal is accordingly disposed of.

Parties to appear before the concerned Family Court on 19th January, 2016. Dasti.
