This hearing has been done through hybrid mode. 2.

The present petition under Sections 11/12 of the Contempt of Courts Act read with Section 151 of the CPC seeks following prayers:- "(a) Initiate contempt proceedings against the contemnors and punish them for committing contempt of order dated order dated 15.01.2025 passed by the Ld. Division Bench of this Hon'ble Court; (b) Allow cost of the petition be awarded in favour of the Petitioner and against the Respondent;

Pass any such order(s) as this Hon'ble Court may deem fit in the facts and circumstances of the present case."

Vide order dated 15.01.2025 in W.P.(C) 438/2025, learned Division Bench of this Court had passed the following directions:- "6. Accordingly, the petitioner is directed to file an appropriate application along with the copy of the instant petition as well as the certified copy of this order before the competent authority i.e., Director, Land Management within one week. After receiving the said application, competent authority i.e., Director, Land Management is directed to treat the said application as representation and dispose of the same after hearing the petitioner and pass a detailed and reasoned order in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned counsel appearing on behalf of respondents has handed up in Court today an affidavit dated 06.11.2025 on behalf of Mr. Aashish Kumar, Dy. Director (LM), DDA, which states as under:- "2. The deponent most humbly submits that the respondent is having high regard to the order passed by the Hon'ble 'Court' and has never and ever shown disrespect to any of the orders passed by the Hon'ble Court. The answering respondent respectfully submits that the respondent has not committed any wilful violation or shown disrespect to any order passed by any Court. The Respondent has the highest respect for all the orders passed by the Hon'ble Courts and has never made any attempt to interfere with the administration of justice by showing disrespect to any of the order passed by the Hon'ble Court. However, if any act of the respondent amounts to be contemptuous the respondent tenders an unconditional apology for the same.

3. The respondent craves leave to submit that respondent/DDA had taken due and earnest steps to comply with all the order dated 15th January 2025 passed in WP No. 438/2025 of this Hon'ble Court in letter and spirit.

4. The respondent received representation dated 3rd February 2025 from the petitioner. Pursuant thereto the petitioner was afforded an opportunity of hearing on 28th July 2025 before the Director Land Management.

5. That the respondent DDA passed a speaking order dated 30th October 2025. Same is annexed as Annexure-l hereto."

Learned counsel appearing on behalf of the petitioner confirms the fact that speaking order has been passed, however, submits that the directions were to pass the speaking order within a period of eight weeks from the date of the order, i.e., 15.01.2025. It is submitted that no explanation with regard to the delay has been given in the aforesaid affidavit. 6.

Compliance of the aforesaid order has been placed on record, although The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the same has been delayed. However, the same cannot be considered as wilful disobedience or non-compliance of the order dated 15.01.2025. 8.

In view thereof, no further directions are called for. 9.

The present petition is disposed of.
